Moral Harassment at Work—The Portuguese Conceptual Case: Persecution vs Intentionality

Equality and access to work are structuring principles of our constitutional system that aim guarantee an equal condition in terms rights duties, fulfilling the basis social dignity human person. Within scope protection equality non-discrimination, we find harassment, as unwanted behavior, with affecting very person, whose article 1 Constitution Portuguese Republic calls for its protection, always based on personality rights, it is this sense I propose analyze other concepts, causes, subjects, effects ways fight prevent. This investigation intends analyze, through a cognitive framework, precise direct way, relationship between persecution (determining factor) intentionality (conditioning factor), aforementioned concepts their jurisprudence, seeking locate trends characterize them, discussing limits potential effects.
